8. Customers in the European Union
For Tesser Customers in the European Union (EU), the following provisions apply:
Purpose and Legal Basis for Processing Personal Data. The purposes and legal bases for processing
your personal data are as follows:
Contract administration. Tesser may process your personal data for the purposes of negotiating,
executing, managing, renewing, and communicating about the contract or any other agreement for
Tesser’s services.
For data subjects in the EU, our processing of your personal data for this purpose is based on GDPR
Article 6.1(b) (“processing is necessary for the performance of a contract to which the data subject is
party” or “in order to take steps at the request of the data subject prior to entering into a contract”), and
GDPR Article 6.1(f) (“processing is necessary for the purposes of the legitimate interests pursued by the
controller”).
Your use as an administrator or user of the services. Tesser may process your full name, physical
address, email address, telephone number, job title, company name, IP address, device information, and
account content, activities and preferences, for the purposes of setting up and managing your account,
interacting with you about your account and the services, providing support, and responding to questions.
For data subjects in the EU, our processing of your personal data for this purpose is based on GDPR
Article 6.1(b) (“ processing is necessary for the performance of a contract to which the data subject is
party),” and GDPR Article 6.1(f) (“processing is necessary for the purposes of the legitimate interests
pursued by controller”).
Compliance with laws, law enforcement requests, protection of Tesser’s rights and preventing fraud.
Tesser may process your personal data to (a) the extent that such processing is necessary to comply with a
law, regulation or legal request from a public authority; (b) to protect or enforce our legal rights and those
of our affiliates or third parties; and (c) to prevent fraud or abuse.
For data subjects in the EU, our processing of your personal data for these purposes is based on GDPR
Article 6.1(c) (“processing is necessary for compliance with a legal obligation to which the controller is
subject),” and GDPR Article 6.1(d) (“processing is necessary in order to protect the vital interests of the
data subject or of another natural person”), and 6.1(f) (“processing is necessary for the purposes of the
legitimate interests pursued by the controller”).
Marketing. Tesser may process your personal data for the purpose of marketing Tesser’s, or its affiliates’,
products or services to you.
For EU residents, our processing of your personal data for these purposes is based on GDPR Article
6.1(a) (processing where the data subject “has given consent to the processing of his or her Personal Data
for one or more specific purposes”), and, for Tesser’s internal purposes related to marketing, GDPR
Article 6.1(f) (“processing is necessary for the purposes of the legitimate interests pursued by the
controller”).
Other Purposes with Your Consent. Tesser may process your personal data for other purposes when you
have given us consent to do so. For example, if we use your personal data in a customer testimonial or
case study, we will ask for your consent before we publish this material.
For EU data subjects, our processing of your personal data for this purpose is based on GDPR Article
6.1(a) (the data subject “has given consent to the processing of his or her personal data for one or more
specific purposes”).
Processing personal data is an absolute requirement for the provision of Tesser’s services. Failure to
provide your personal data may mean that you will not be able to use Tesser’s services.
Retention Period. Tesser retains your personal data for as long as the data is relevant for the purpose of
providing services. Tesser typically deletes customer data six months after the services are terminated, in
order to facilitate the renewal of services. Tesser may retain your data for a longer period, if such
retention is required by law, or if any litigation or investigation arises that involves your data.
Transfers Outside the EU. Tesser may transfer your personal data outside of the EU. When Tesser
transfers your personal data to a controller or processor outside the EU, Tesser ensures that the transfer
occurs under the necessary legal provisions required by the GDPR (e.g., standard data protection clauses
adopted by the European Commission, or an approved certification mechanism, like the EU-U.S. Privacy
Shield).
Your rights. EU residents have the following rights regarding Tesser’s processing of EU resident personal
data:
• Access to one’s personal data;
• Request rectification, erasure, or restriction of processing;
• Object to the processing;
• Request the personal data in a format at Tesser’s discretion that allows for data portability;

consent;
• The right to lodge a complaint with the relevant supervisory authority.
Automated decision-making. Tesser does not use personal data for any automated decision-making
process or technique that creates or denies any right or benefit to you.
Lodging a complaint. You have the right to lodge a complaint with the competent data protection
authority. Information on how to find your data protection authority and how to lodge a complaint can be
